These Terms of Use ("Terms") govern your access to and use of Zulu, including our website, mobile application, customer support channels, and related services ("Services") operated by Flick Media Pvt Ltd ("Company", "we", "us", or "our"). By using Zulu, you agree to these Terms and our Privacy Policy.
1. Acceptance and eligibility
You must have the legal capacity to enter into a binding agreement under applicable law. Zulu is launching in Lucknow, India, and may be used only where the Services are available. If you are under 18, you may use the Services only with the involvement and consent of a parent or legal guardian.
2. Account registration and security
You may need to register or authenticate using your mobile number, OTP, or other supported methods. You agree to provide accurate information, keep your account secure, maintain updated delivery and contact details, and notify us of unauthorized use. We may verify, suspend, restrict, or terminate accounts to protect users and the platform.
3. Service availability
Zulu services are launching in Lucknow. Product availability, pricing, delivery timelines, offers, payment methods, and support options may vary by service area, inventory, delivery partner availability, weather, traffic, law, operational conditions, and other factors. We may refuse, cancel, or limit orders where service is unavailable or where an order cannot be fulfilled.
4. Orders, pricing, and substitutions
Product images and descriptions are provided for convenience and may vary from actual items due to packaging changes, availability, or supplier updates. Prices, taxes, fees, delivery charges, platform charges, discounts, and offers may change before checkout. An order is accepted only when confirmed by Zulu. If an item is unavailable, we may cancel that item, offer a replacement, or process a refund as applicable.
5. Payments
Payments may be processed through third-party payment gateways and supported payment methods such as UPI, cards, wallets, net banking, cash on delivery, or other options made available in the app. You agree that payment failures, reversals, chargebacks, suspicious transactions, or non-payment may lead to order cancellation, collection actions, account restrictions, or other remedies available under law.
6. Delivery
Zulu aims to deliver eligible orders in Lucknow within 1 hour where service is available. Delivery timelines shown in the app are estimates unless expressly stated otherwise and may vary due to inventory, distance, traffic, weather, operational load, delivery partner availability, or other factors. You are responsible for providing accurate delivery information, being available to receive the order, and complying with delivery partner instructions. Failed delivery attempts, unreachable customers, unsafe delivery conditions, restricted locations, or incorrect addresses may result in cancellation or additional charges.
7. Cancellations, returns, and refunds
Cancellation, return, replacement, and refund eligibility depends on product type, order status, condition of goods, hygiene and safety considerations, applicable law, seller policies, and Zulu's published in-app policy. Perishable, opened, used, damaged-after-delivery, hygiene-sensitive, customized, or time-sensitive products may not be returnable unless required by law or confirmed by us. Approved refunds may be issued to the original payment method, wallet, credits, or another supported method.
8. User conduct
You agree not to:
- Use Zulu for unlawful, fraudulent, abusive, or harmful purposes.
- Provide false identity, contact, address, payment, or order information.
- Misuse offers, referrals, coupons, refunds, cancellations, or delivery workflows.
- Harass, threaten, abuse, or discriminate against support teams, delivery partners, sellers, or other users.
- Access, scrape, copy, reverse engineer, or disrupt our systems without authorization.
- Upload or transmit malware, spam, misleading content, or infringing material.
9. Intellectual property
Zulu, its logos, designs, software, text, graphics, interfaces, trademarks, and other materials are owned by or licensed to us. You receive a limited, revocable, non-exclusive, non-transferable license to use the Services for personal, lawful shopping purposes only.
10. Third-party products and services
Zulu may list products supplied by sellers, brands, distributors, or third-party partners. We may also link to or integrate third-party services such as payment gateways, analytics providers, maps, communication platforms, or delivery partners. Their terms and privacy practices may apply separately.
11. Privacy and communications
Our Privacy Policy explains how we handle information. By using Zulu, you consent to receive service communications related to your account, orders, payments, delivery, security, and support. Promotional communications may be sent where permitted and can be opted out of through available controls.
12. Disclaimers
The Services are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted service, error-free operation, exact delivery timelines, uninterrupted inventory availability, or that every product description, image, price, or offer will be free from error.
13. Limitation of liability
To the maximum extent permitted by applicable law, Flick Media Pvt Ltd will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, or for losses arising from service interruptions, product unavailability, payment gateway issues, delivery delays, user error, third-party acts, or events beyond our reasonable control.
14. Indemnification
You agree to indemnify and hold us harmless from claims, damages, losses, liabilities, costs, and expenses arising from your misuse of the Services, violation of these Terms, violation of law, fraud, abusive conduct, or infringement of third-party rights.
15. Suspension and termination
We may suspend, restrict, or terminate access to Zulu if we believe you have violated these Terms, created risk for other users or our operations, engaged in fraud or abuse, failed to pay amounts due, or used the Services unlawfully. You may stop using Zulu at any time and request account deletion as described in our Privacy Policy.
16. Changes to the Terms
We may update these Terms periodically. Material changes will be posted on our website or app. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
17. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to applicable law, disputes will be subject to the exclusive jurisdiction of courts in Noida, Uttar Pradesh.
